Since 25 May 2018, the new Information Notice pursuant to art. 13 -14 EU Regulation/2016/679, known as GDPR (General Data Protection Regulation), has been in force in all member states of the European Union and has modified the previous regulations on the processing of personal data. Termotek S.r.l. is obliged to make this informative note in order to inform its customer / user of all the rights recognized in terms of personal data protection. In relation to the content of the information, you will be asked to give your consent to the processing, transfer and communication of personal data for the purposes detailed below. Whether or not consent is given will have the consequences specifically indicated in point 7 of this informative note.

3. Purpose of the processing
In accordance with the Information Notice ex art. 13 -14 EU Reg./2016/679 (GDPR), Termotek is obliged to inform you that all data concerning the customer / user provided by it and all data that may be provided afterwards, will be used for the purposes of
- a) to fulfil fiscal, civil, administrative obligations aimed at managing the relationships established with Termotek and the services provided by the same;
- b) sale and delivery of products and services. The personal data provided by users are used to receive and manage orders, provide products and services, process payments, ship with couriers and communicate with customers regarding their orders, products, services
- c) provide chat line and forum services, newsletters as well as with reference to any other service offered and provided in favour of registered parties to the Termotek community that is necessary for the performance of the relationship;
- d) to provide assistance and technical information regarding the services and products that are the object of Termotek’s activity and to verify the satisfaction of the latter; to carry out e-commerce activities;
- e) to carry out analysis, market surveys and statistics, to survey the degree of satisfaction of customers / users and their preferences with regard to the services that Termotek, its subsidiaries, affiliates, subsidiaries, commercial partners, advertisers of Termotek;
- f) carrying out, also by sending e-mails, sms, mail and other means of communication and data transmission, prize games, draws and promotional initiatives in general, in the interest and to the advantage of customers / registered users;
- g) processing of the Data provided by the customer / registered user and those inferred from his or her navigation on the Termotek website to identify the commercial profile and for the use of the same for marketing, advertising, promotional and commercial purposes both of Termotek and of Termotek’s affiliates, subsidiaries, commercial partners, advertisers with links on the Termotek website.
4. Legal basis and Purpose of the Processing – Methods of Data Collection
- a) consent of the interested party; These are the data entered on the Site by Customers
- b) respond to the requests of the interested party; i.e. Personal data expressly communicated by customers for information or orders by phone or chat
- c) Data collected automatically during navigation (via Cookies. Read information)
Personal data is collected by Termotek S.r.l. in the following ways:
- a) Personal Data entered on the Site by Users and/or Customers: this is the Personal Data provided, by way of example and not exhaustive, to surf, register and access the Additional Services and the Service offered through the Site itself;
- b) Personal Data expressly communicated by Users and/or Customers in offline mode: this is the Personal Data provided, by way of example, to customer service (in case of contact request).
- c) Personal Data automatically collected by the Site: this is Personal Data automatically collected by the Site through, but not limited to, Cookies (for further information, please read the Cookies policy: ).
5. Profiling and other automated decision making mechanisms
The data collected includes automated profiling processes, which means that we may collect certain information related to product and purchase preferences for the sole purpose of providing a better browsing experience.
6. Treatment Modes
The methods of data processing and communication are carried out in close connection with the purposes set out in point 3 and the relative consent, by means of instruments suitable to guarantee security and confidentiality in accordance with Title V, Chapters I and II of the Code. They may also be carried out by electronic means at the registered office of the Data Controller. The processing will also be carried out through a process that allows to detect the user’s attitudes expressed through navigation (cookies). Cookies are information sent to the user’s browser by a Web server which is saved on the hard disk of the user’s pc; cookies help to improve the navigability of the site, to offer personalised services and to allow the user to subscribe to the Termotek community The user can choose not to accept cookies sent by modifying the settings of his or her browser so that it rejects all cookies, or it can make the browser show when a cookie has been sent, so that it can decide whether or not to receive it. If you choose not to accept such cookies, your navigation on the Termotek website may be limited and some features may not work as they should. The data will be stored at the registered office of Termotek S.r.l., with registered office in Via San Raffaele, 1 20121 Milan (MI) or in the place where the servers hosted by the service provider reside.
7. Provision of data and consequences
The conferment of the Data that may be requested by Termotek and the relative consent to the processing, communication and transfer, for the strict purposes referred to in point 3, letters from a) to d), are mandatory for the execution of the relationship. Any refusal to provide the requested Data or to give the relative consent to the processing, communication and transfer would result in the failure to establish the relationship and the impossible execution of contractual and legal obligations connected to the relationship. The provision of the data that may be requested by Termotek and the relative consent to the processing, communication and transfer, for the sole purposes set out in point 3, letters from e) to g), are optional. The refusal, however, may make it impossible to achieve the purpose itself.
8. Consequences in case of refusal
In the event of refusal to give consent to the data for the purposes indicated in point 3, it will be impossible for Termotek to provide the service.
With regard to the marketing activities indicated in point 3, letter f, this results in the impossibility to receive information related to commercial information.
9. Recipients of the Treatment
Employees, collaborators, third party IT service providers, technical and commercial third parties.
Personal Data are processed by Termotek and/or by third parties, selected for reliability and competence, and to which they may be communicated as necessary or appropriate, provided they are within Italy or the European Union.
In particular, it informs Users that Personal Data may be processed by, and/or communicated to:
- Employees and/or collaborators of Termotek S.r.l.
- Third party service providers necessary to guarantee the functioning of the Site (by way of example: companies dealing with hosting services
- Third party providers of services necessary for the use of the Service (e.g. payment managers);
- Administrative authorities for the management of sales and related accounting
- Third parties who provide services for the analysis of Site navigation data;
- With the optional consent of the User and/or Customer, third parties providing automatic services for sending newsletters and/or any other type of commercial communication, marketing services, promotion, analysis of consumption habits and choices, Profiling.
- In case of purchase of products containing Gas Florurato the data relative to the person and to the shipment will be supplied, according to the law, to the F-Gas entity.
10. Site Security Measures
Termotek uses security services to preserve the data provided by customers during registration and purchase. For this purpose, protection measures are adopted during authentication to verify the actual ownership of the User.
11. Place of Processing
The data will be stored at the operational headquarters of Termotek S.r.l., or in the place where the servers hosted by the service provider reside.
12. Application systems adopted
The data provided with the direct consent of the person concerned, i.e. by registering on the site, purchasing through the site or registering for the newsletter are stored and used through the following applications:

13. Data retention
Personal Data will be processed for the time strictly necessary for the purposes mentioned and/or for the fulfilment of regulatory obligations. Should you deny your consent to cookies or other commercial services, your information will be deleted.
Personal Data will be stored according to the following criteria:
- for a period of time not exceeding that necessary to achieve the purposes for which they are processed;
- for a period of time not exceeding that necessary for the fulfilment of regulatory obligations
- They will also be stored in order to allow you to use the service offered by Termotek on an ongoing basis.
14. Privacy rights of the interested party
Pursuant to art. 7 of the Code, the interested party is entitled to the following rights. The interested party has the right to obtain confirmation of the existence or not of personal data concerning him/her, even if not yet recorded, and their communication in an intelligible form. The interested party has the right to obtain the indication:
a) the origin of the personal data;
b) the purposes and methods of processing;
c) the logic applied in case of processing carried out with the aid of electronic instruments;
d) the identification details of the owner and the persons responsible;
e) the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of such data in their capacity as data processors or persons in charge.
The interested party has the right to obtain:
a) updating, rectification or, when interested therein, integration of the data;
b) the cancellation, transformation into anonymous form or blocking of data processed unlawfully, including data whose retention is unnecessary for the purposes for which the data were collected or subsequently processed;
c) certification to the effect that the operations as per letters a) and b) above have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.
The interested party has the right to object, in whole or in part:
a) for legitimate reasons to the processing of personal data concerning him/her, even if pertinent to the purpose of collection;
b) to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys. The rules on professional secrecy of the journalistic profession remain unchanged, limited to the source of the news.
